Cancellation & return
Weingut Ing. W. Baumgartner GmbH & Co KG is until cancellation prepared to take back items purchased by you for a full refund on the purchase price, subject to the following requirements: The return must be made within 14 days of the billing date, in the original packaging, undamaged and with the original receipt. Returns on labelled special offers will only be accepted if all items included in the offer are returned. The refund will be for the price which was valid when the original purchase was made. The refund will be made in the form of a credit note or transfer.
If the buyer is a consumer within the meaning of the Konsumentenschutzgesetz (Austrian Consumer Protection Act) and they submitted their order by post, over the phone, by fax or email, or via the online shop, they may declare that they are withdrawing from the purchase agreement within fourteen days of the day when they receive the item, in accordance with Section 11 FAGG (Fern- und Auswärtsgeschäfte-Gesetz, Austrian Distance Selling Act) and in derogation from Point 5.1. The cancellation period begins as soon as the buyer or a third party appointed by them has accepted the goods. If a purchase agreement is concluded for multiple items, the cancellation period shall begin as soon as the buyer or a third party appointed by them has accepted the last partial consignment, the last goods or the last item. The day of acceptance is not included in the period. Saturdays, Sundays and public holidays are not included in the calculation of the period. The timely dispatch of the declaration of withdrawal and/or return dispatch of goods is sufficient to comply with the withdrawal period.
In order to exercise your right of cancellation, you must inform Weingut Ing. W. Baumgartner GmbH & Co KG Handelsgesellschaft m.b.H., Weingut Baumgartner Platz 1, 2061 Untermarkersdorf, Tel.: +43 0 2943 25 90; email: weinkellerei@wein-baumgartner.at) of your decision to cancel this agreement by way of a clear declaration (e.g. in a letter sent by post, fax or email). To meet the cancellation deadline, it is sufficient to notify us that you intend to exercise your right of cancellation before the cancellation deadline.
Consequences of cancellation: If you cancel this agreement, Weingut Ing. W. Baumgartner GmbH & Co KG must refund payments received from you, including delivery costs (with the exception of additional costs resulting from the fact that you chose another delivery method than the most economical standard delivery offered by Weingut Ing. W. Baumgartner GmbH & Co KG), without undue delay and within fourteen days at the latest from the day when Weingut Ing. W. Baumgartner GmbH & Co KG received the notice regarding your cancellation. For this refund, Weingut Ing. W. Baumgartner GmbH & Co KG will use the same payment method that you used for the original transaction, unless we explicitly agreed otherwise with you. In no event will you be charged fees for this refund. Weingut Ing. W. Baumgartner GmbH & Co KG may refuse to provide a refund until Weingut Ing. W. Baumgartner GmbH & Co KG has received the goods, or until you have provided evidence that you have returned the goods, whichever is earliest. You must return the goods to Weingut Ing. W. Baumgartner GmbH & Co KG, Weingut Baumgartner Platz 1, 2061 Untermarkersdorf, without undue delay or at the latest within fourteen days from the day when you inform Weingut Ing. W. Baumgartner GmbH & Co KG that you are cancelling the agreement. You are considered to have met the deadline if you send the goods back before the fourteen day period passes. You bear the direct costs as well as the risk of sending the goods back. You only need to pay for any diminished value of the goods if such a loss in value is due to the handling of the goods which was not part of an inspection necessary to check the quality, features and functioning of the goods.
